The following four years Scott resided there while working for hire during the protracted periods while Emerson was abroad.

Scott and his family relocated to Louisiana in 1840 before following Emerson to St. Louis. Eliza Irene Sanford, Emerson's wife, received the Scott family upon his death in 1843. The Scotts tried to buy their freedom from Sanford in 1846 after years of toiling and saving, but she refused.

Dred Scott then filed a lawsuit against Sanford in a state court, asserting his legal freedom as a result of having lived with his family in a region where slavery was illegal. The state court eventually ruled Scott free in 1850.
