4. The law should not dictate the sentence for a particular crime, it makes much more sense solely for the judge to make that decision in a certain sense for a crime. A judge interprets the law, imposing sentences, issuing subpoenas etc. It would be better for a judge to make the decision.

Service should always happen in person to get a better understanding of them just reading them off a piece of paper, dropping off paper is okay too and it would be a faster process for the defendant/witness to access the documents. In person it makes much more sense. If a person refuses a summons, what I believe would happen to them according to my notes is that in most cases they are legally allowed to, but it doesn't stop them from having a lawsuit against them.
